Feliz Face Painting — Terms & Conditions

1. Introduction

Welcome to Feliz Face Painting. These Terms & Conditions (“Terms”) govern your booking and use of our face-painting services, website and any related communications. By contacting us, booking our services, or using our website, you accept these Terms.

3. Services

We provide professional face painting and related event entertainment services for private, public and corporate events. Service specifics (start time, end time, number of artists, rates, designs offered) are agreed in writing at booking.

4. Quote, deposits & payment

• A written quote or invoice will be provided for each booking, upon request.

• To confirm a booking we require a deposit of $50 unless otherwise agreed in writing. The deposit amount and due date will be shown on the invoice.

• Final payment is due the day of the event before the end of your booking. We accept cash, cheque or e-transfer. Unpaid balances may incur interest and/or collection charges.

 

5. Cancellation and refunds

• If you cancel more than 48 hours before the event, we will refund your deposit, per the written booking terms.

• If you cancel within 48 hours of the event, the deposit is non-refundable and additional fees may apply to cover lost bookings and administrative costs.

• In New Brunswick, sellers are not generally required to offer refunds simply because a consumer “changes their mind.” Businesses should still clearly state their refund and cancellation policy and follow applicable consumer protection rules. Please check the policy above for how cancellations are handled.

If a consumer protection statute or rule (federal or provincial) provides additional cancellation or refund rights for a particular situation, those rights will apply.

6. Changes and substitutions

We will make reasonable efforts to accommodate reasonable client requests for changes. If changes affect staffing, travel or materials and are requested close to the event date, additional charges may apply.

7. Illness, emergencies & artist substitutions

• If a booked artist becomes ill or is otherwise unavailable, Feliz Face Painting will make reasonable efforts to provide a suitably skilled substitute.

• If we cannot provide the service, you will be offered a credit, reschedule or refund for amounts paid, at our discretion.

 

8. Venue, setup & client responsibilities

• The client must provide a safe, well-lit, sheltered workspace near event activities with access to seating and a table for supplies, and a chair for the guest if applicable.

• If our artist must travel significant distances, a travel fee may apply. Travel and parking must be provided free of charge or reimbursed.

• The client is responsible for obtaining any venue permissions required for face painting services.

 

9. Health, allergies & safety

• Please inform us of known allergies, skin conditions, or sensitivities in advance. We use professional, cosmetic-grade paints intended for face/body painting. We cannot guarantee no reaction; clients accept the small risk of skin reactions.

• We reserve the right to refuse service for anyone showing signs of illness or for whom painting would create a health risk. We will not paint over broken or infected skin.

 

10. Minors / Consent

For children under age 12, a parent or guardian must provide consent and be present or available onsite while painting occurs.

 

11. Use of images & publicity

By booking, you grant Feliz Face Painting a non-exclusive right to photograph or video the work performed and to use those images for portfolio, marketing, social media and website purposes unless you notify us in writing before the event that you opt out. If you require model releases for particular guests, please notify us in advance.

 

12. Intellectual property

Our designs, portfolio images, logos, and website content are protected by copyright and may not be reproduced for commercial use without our written permission.

 

13. Liability, disclaimers & limitation of damages

• Except for death or bodily injury caused by our negligence, and to the fullest extent permitted by law, Feliz Face Painting’s liability for any claim arising from our services is limited to the amount paid to us for the booking.

• We are not responsible for indirect, incidental, special, or consequential damages.

• For safety and fairness, clients accept that artists will follow hygienic and industry standard practices.

 

14. Indemnity

You agree to indemnify and hold Feliz Face Painting harmless from any claims, damages or expenses arising from your breach of these Terms or from your guests’ actions.

 

15. Force majeure

We are not liable for failures due to causes beyond our reasonable control (e.g., extreme weather, acts of God, government action, pandemic-related restrictions, travel disruptions). In these cases we will attempt to reschedule or offer a refund or credit, as appropriate.

 

16. Privacy, communications & marketing

• Our privacy practices are set out in a separate Privacy Policy available at [privacy policy]. That policy explains what personal data we collect and how we use it. A privacy policy is a legal requirement for websites that collect personal information. 

• If you opt to receive marketing communications from us, we will only send Commercial Electronic Messages (CEMs) in compliance with Canada’s Anti-Spam Legislation (CASL): we will obtain express or implied consent before sending promotional emails or texts and we will provide clear unsubscribe options in every message. 17. Consumer protection & statutory rights

These Terms are subject to any non-waivable rights you may have under applicable federal or provincial legislation (including New Brunswick consumer protection laws). To the extent a provincial statute gives consumers stronger rights than these Terms, the statute will prevail. New Brunswick has recently updated consumer protection legislation which may affect cancellation and unfair practices rules; businesses should ensure their policies align with current provincial requirements. 18. Governing law and disputes

These Terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable therein. You and Feliz Face Painting agree to submit to the exclusive jurisdiction of the courts of New Brunswick for any dispute arising from these Terms. Choice-of-law clauses are generally upheld in Canada provided they are made in good faith. 

 

19. Changes to Terms

We may revise these Terms from time to time. Changes will be effective when posted on the website with an updated “Effective date.” Your continued use of our services or website after changes are posted constitutes acceptance.

 

20. Severability & entire agreement

If any provision is held invalid or unenforceable it will be severed and the remainder of these Terms will remain in force. These Terms and any documents they reference constitute the entire agreement between you and Feliz Face Painting regarding the services.
